These Terms of Use ("Terms") apply to your access and use of the CallGauge AI website, dashboard, call tracking tools, tracking number(s), analytics, integrations and any related products and services (collectively the "Services").
Important Notice
By using or visiting the Services, you accept these Terms. If you do not accept, then please do not use the Services.
Definitions (plain-language)
"CallGauge AI," "we," "us," "our"
means the company operating the Services.
"You," "your," "Customer"
means the person or business using the Services.
"Account"
means your user profile and workspace.
"Content"
refers to data you upload or submit, including numbers, audio files, CRM records, Tags and settings.
"Call Data"
includes any logs of calls, call metadata, recorded calls and voicemails (if available), transcriptions and summaries, sentiment and insights generated by the Service, and attribution information that is created on or processed by the Service.
Eligibility and Authority
You must have the legal capacity to form a contract in order to use the Services. If you use the Services on behalf of a business, you represent and warrant that you have authority to bind such business to these Terms.
Your Account and Security
You are responsible for:
- keeping login credentials secure,
- that all Account use is in accordance with these Terms, and maintaining accurate Account information.
Security Notice
If you believe that there has been unauthorized access to your Account please contact us immediately.
The Services (What We Provide)
CallGauge AI provides call tracking and attribution tools, which may include:
Customer Responsibilities (Very Important for Call Tracking)
Legal Compliance Responsibility
You are responsible for how you use the Services, including compliance with all applicable laws.
A) Consent, recording the conversation, and Notice Requirements
Call recording and consent laws differ by location (i.e. one-party versus all-party consent). If you use recording, transcription or AI analysis features, you consent to the following:
- you will provide any required disclosures/notices to callers
- you will obtain any legally required consent
B) Phone, telecom and telemarketing compliance.
You are also responsible for any applicable law related to usage and/or use not limited to, (where applicable):

Enforcement
We may suspend or terminate Accounts that violate these conditions.
Trials, plans, billing and taxes
A) Plans and Pricing
Some features may require a premium plan. Plan specifics are displayed in your account or on our pricing pages as applicable.
B) Free Trials (If Offered)
A trial version of the software may be limited to time on your computer or have some features disabled. You will lose temporary access if your trial expires before you upgrade.
C) Billing and Renewals
If you purchase a subscription:
- you authorize us (and our designated payment processor) to charge your designated method of payment for the applicable subscription fees and/or other usage charges;
- subscriptions automatically renew unless cancelled,
- you are responsible for all taxes, duties, and similar charges (unless we're required to collect them)
D) Late Payment
In the case of non-payment or overdue payment, we may suspend or limit Service until payment is settled.
E) Refunds
Fees are non-refundable except as required by law or as specifically provided in these Terms. If you have received a mistaken charge, simply contact support right away.
Third-Party Services and Integrations
The Services may connect with third-party platforms (CRMs, ad platforms, automation tools, etc.). When you enable an integration:
- you consent to data being shared as is necessary to allow the integration to function
- third party services are subject to their own terms and policies
- we do not assume liability for system holdups on third-party sides, data processing, or revision of their APIs
Data, Call Data, and Privacy
The manner in which we collect and use personal information is set out in our Privacy Policy.
You own your Content and Call Data. You give us a limited license to process it for those purposes:
- provide and improve the Services
- secure and maintain the platform
- comply with legal obligations
Your Responsibility
You are responsible for any and all data that you transmit, share or store through the Services and you warrant that you have all rights in such data necessary to use it with the Services.
Features involving AI (transcripts, summaries, scoring)
AI Limitations Notice
AI outputs may contain errors, omissions, or misunderstandings.
If you enable AI features:
- You are responsible for reviewing outputs before using them for decisions, compliance, or legal purposes.
- AI insights are provided "as is" and should not be treated as professional advice.
Intellectual Property
The Services, software, design, and content of the Services are copyright © EV Connect LLC or our licensors (including We own the Services, software design, and all related copyrights.
You are not permitted to use our branding, trademarks or logos without the explicit written consent of West London Models.
You are granted a revocable, limited, non-sublicensable license to access and use the Services while your subscription is active, all in accordance with this TOU.
Confidentiality (Business-to-Business)
If You receive non-public information regarding CallGauge AI, You will keep it confidential, and only use it in the context of evaluating or using the Services. This does not apply to information that is publicly available by means other than through a disclosure in violation of this paragraph.
Service Availability and Changes
We strive to provide you with reliable service, but we do not warrant that the site will operate without interruption. Availability may be impacted by maintenance, updates, carrier/network services and third party providers.
We may change or discontinue the Services (including, but not limited to, the availability of any feature) at any time. If a modification reduces essential core functionality of a paid plan, we’ll make reasonable efforts to notify you.
Suspension and Termination
A) Suspension
We may suspend access if:
- you violate these Terms
- your use creates security, legal, or operational risk
- payments are overdue
- we're required to do so by law
B) Termination by You
You can cancel your subscription via your dashboard (or reach out to customer support if you don’t see cancellation tools).
C) Termination by Us
We may disable the Services or your Account for serious or repeated violations of these Terms, if needed to comply with the law.
D) Effects of Termination
After termination:
- your access to the Services terminates
- some data may be deleted after a retention period
- outstanding fees remain payable
Disclaimers
The Services are provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee:
- 100% attribution accuracy
- uninterrupted tracking across every device/browser/network
- carrier/network behavior
- that AI outputs will be error-free
Limitation of Liability
To the maximum extent permitted by law:
- CallGauge AI will not be liable for indirect, incidental, special, consequential, or punitive damages (including lost profits, lost revenue, lost data, or business interruption).
- Our total liability for any claim related to the Services will not exceed the amount you paid to us in the three (3) months immediately before the event giving rise to the claim.
Indemnity (You Protect Us If Your Use Causes Harm)
You will indemnify and hold harmless CallGauge AI from any third party claims resulting from:
- your misuse of the Services
- your breach of these Terms
- your violation of laws (including recording/consent rules)
- your Content, campaigns, or business practices
Governing Law and Disputes
These Terms, and any dispute between you and us over the Items or Services, are governed by [Insert Jurisdiction] law, without regard to its conflict-of-laws rules.
Dispute Resolution
Before filing legal action, you agree to contact us first and attempt to resolve disputes informally.
Changes to These Terms
